Federal Court Mandates Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her order, the judge noted that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
